A: The nation wide limit is .08% BAC
Q: What is field sobriety test? Do I have to take it?
A: No you are not legally obligated to take a field sobriety test. However, be aware upon refusal, you will be arrested for a DUI or DUI related offense. There are three standard field sobriety tests:
- Walk and Turn Test
- Horizontal Gaze Nystagmus Test
- One Leg Balance Test

Q: Do I have to allow the Blood Alcohol Concentration test?
A: We strongly suggest you permit this test, if you deny the test- you will lose your license for a year for the first offense and two years for the second or subsequent offenses.
Q: Will I have to go to jail?
A: If you are convicted, yes. You will have to be incarcerated for at least 48 hrs.
